The London Elects Website ("the Website") is maintained by London Elects for your personal use and viewing.
These Terms and Conditions apply to the entire contents of the Website under the domain name www.londonelects.org.uk and to any correspondence between us and you relating to the Website.
Please read these terms carefully before accessing the Website. Your use of this Website indicates that you accept these terms, and this takes effect from the date of first access to the Website.
If you do not accept these terms, do not use this Website.
1. The Website
1.1. The Website and all information and materials contained within the Website have been prepared for access and use only by persons in the United Kingdom. We do not represent or warrant that the information or materials contained on the Website comply with the regulatory regime of any other country.
1.2. If you are accessing the Website from outside the United Kingdom, you do so at your own risk, and you are solely responsible for compliance with local laws.
1.3. London Elects reserves the right to change these Terms and Conditions, the Privacy Policy or any other policies at any time. Any changes will be effective from the time that they are posted on the Website. Your continued use of the Website will signify your acceptance of the changes.
2. Your use of the Website
2.1. You are permitted to view, print and download extracts from this Website for your own personal, non–commercial use on the following basis:
2.1.1. That you do not modify any extracts in any way.
2.2. The permission under clause 2.1 does not extend to any material contained on the Website which is marked as being the copyright material of a third party. You must obtain permission directly from that third party before use of such material.
2.3. You may not copy, sell, lease, rent, license, sub-license, grant any rights in, transfer, distribute, time-share or otherwise assign any part of this Website to any third party.
2.4. Where you intend to use content or material on the Website for purposes other than those permitted in clause 2.1, prior written consent must be obtained from London Elects.
3. Intellectual Property Rights
3.1. The copyright and all other intellectual property rights in all materials on the Website (including without limitation, photographs and graphical images) are owned by London Elects or its licensors, unless otherwise stated.
3.2. The names, images and logos of London Elects are proprietary marks of London Elects and copying of these is not permitted without prior approval from London Elects.
4. Your access to the Website
4.1. London Elects endeavours to ensure that the Website is available 24 hours a day, 7 days a week. However, London Elects shall not be liable if for any reason the Website is unavailable at any time for any period.
4.2. London Elects may suspend access to the Website in the event of system failure, maintenance, repair or for any other reason which in the opinion of London Elects justifies the suspension of access.
5. Visitor conduct and material
5.1. If you transmit or post any information to this Website, it will be considered to be non-confidential and non-proprietary (with the exception of Personal Data which is covered by the Privacy Policy). In transmitting or posting information to the Website, you consent to London Elects copying, disclosing, incorporating or otherwise dealing with such material and all data, images, sounds, text and other things embodied therein for any and all commercial and non–commercial purposes.
5.2. You must not use the Website in order to hack or gain other illegal or unauthorised access to other computers.
5.3. London Elects will co-operate fully with any law enforcement authority or court order requesting or directing London Elects to disclose the identity of anyone posting any material in breach of this paragraph 5.
5.4. In the event that your use of the Website results in the need for servicing, repair or correction of equipment, software or data, you shall be liable for all costs incurred by London Elects.
6. Third party access to the Website
6.1. London Elects shall not be liable for any loss or damage caused to any user due to any alteration or amendment made to the Website by an unauthorised third party.
7. Links to and from other websites
7.1. The Website contains links to other websites, which are provided for your convenience. London Elects has not reviewed these websites and does not control or take responsibility for the content and availability of any third-party websites. London Elects therefore, does not endorse or make any representation regarding the material on these third-party websites. If you access any of the third-party websites, you will be leaving this Website and you access the third-party website entirely at your own risk.
7.2. You do not have to ask permission to link directly to pages hosted on the Website and we do not object to you linking directly to information that is contained within the Website, provided that you do not do so in a way which could give any impression of compromising the political neutrality of London Elects, or which is offensive or otherwise objectionable.
8. Disclaimer
8.1. London Elects generally endeavours to ensure that the information on the Website is correct and up to date. London Elects does not however warrant the accuracy and completeness of the material on the Website and may make changes to the material on the Website at any time without notice. The material on the Website, including material relating to the state of the law, may be out of date and London Elects makes no commitment to update such material.
8.2. The material on this Website is provided "as is" without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, London Elects provides you with this Website on the basis that London Elects excludes all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for a particular purpose, non–infringement, compatibility, security and accuracy.)
9. Liability
9.1. Subject to 9.2 below, London Elects excludes all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including but not limited to, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort, contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of (including reliance on the contents thereof) use of the Website, any websites linked to the Website or the materials on such websites.
9.2. London Elects does not exclude or limit liability for death or personal injury caused by the negligence of London Elects.
10. Privacy policy
10.1. All personal data submitted to the Website by visitors will be processed in accordance with the principles of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and the Website Privacy Policy. Links provided to other websites are not covered by our Privacy Policy and it is your responsibility to check the privacy statements when visiting third party websites.

12. General
12.1. Reference to any statute or statutory provision includes a reference to the statute or statutory provision as from time to time amended, extended or re-enacted.
12.2. These Terms and Conditions are governed by and construed in accordance with English Law. Any dispute arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English Courts.
Privacy notice
Who we are and what we do
London Elects is the programme team that organises Mayor of London and London Assembly elections (GLA Elections). While part of the Greater London Authority (GLA), London Elects is politically impartial and operationally independent. It works directly for the Greater London Returning Officer (GLRO) and has a separate budget.
The GLRO has overall responsibility for delivering the GLA Elections as a whole. She is directly responsible for the nominations process for Mayor of London and the 11 London-wide Assembly Member candidates. The GLRO also oversees the collating and counting of the votes by Constituency Returning Officers (CROs) from across London for the Mayoral and Assembly members (14 Constituency and 11 London-wide seats) elections at various count centres.
The GLRO announces the Mayoral and 11 London-wide Assembly members elections results from City Hall. CROs announce the 14 Constituency Assembly member election results at their count centres.
For the purposes of UK data protection legislation, the GLRO is the data controller for the processing of personal data by London Elects or as part of the nomination, voting and election processes.
The GLRO is a separate data controller to the Greater London Authority.

Why we handle personal information
Under data protection legislation, the GLRO is only allowed to process personal information if they have a proper reason (known as a 'legal basis') to do so.
The ‘legal basis’ relied on to process the personal data we hold will depend on way in which you have engaged with London Elects, or the service or product you use or sign up for. It will be necessary to handle your personal information in connection with you being (as applicable) a candidate, election agent or sub-agent, subscriber to a candidate’s nomination, or an officer of a political party, supporter/ campaigner or voter in the Mayor of London & London Assembly elections.
The GLRO has legal obligations concerning the nomination of candidates and conduct of the elections under the Greater London Elections Rules 2007, the Representation of the People Act 1983, the Electoral Administration Act 2006 and Greater London Authority Act 1999 (as amended) and other applicable election legislation. This includes publishing personal data in official election notices, on ballot papers, in official declarations and returns by the GLRO and CROs in connection with the elections as required by electoral law, including in relation to any legal challenge to the declared results.
In addition our handling of your personal information will be necessary in connection with the submission by election agents on behalf of participating mayoral candidates of campaign addresses or statements (including statements regarding political opinions) for inclusion in the “mayoral candidates election addresses booklet” where the GLRO’s legal obligations concerning the preparation and distribution of the booklet to electors under the Greater London Authority Elections (Election Addresses) Order 2003 (as amended).
Personal data about voters
Neither London Elects nor the GLRO are responsible for updating or maintaining information about individual voters or the Electoral Register (sometimes called the ‘electoral roll’). If you move house or change your name, you must register with your new details online or contact your local authority.

The GLRO will process personal data from the Electoral Register for the purpose of administering the Mayor of London & London Assembly elections and for complying with candidates’, agents’, subscribers’ , political parties’, supporter/ campaigners’ and voters’ legal responsibilities; for example, verifying the identity of subscribers to candidate’s nominations or sending information about candidates to registered voters.
Personal data about candidates
Information provided by candidates, election agents, subscribers, political parties and campaigners is processed for the purpose of the nomination of candidates and conduct of the Mayor of London & London Assembly elections and for the preparation and distribution to electors of the mayoral candidates’ election addresses booklet up to and after the declaration of results as required by electoral law, including in relation to any legal challenge to the declared results.

1. The information we collect and how we use it
London Elects collects personal information from you in several ways whilst you use the Website:
1.1. Information provided by you: When you sign up for emails or text message alerts with the Website we will need to know your name and email address and you have the option to provide your mobile phone number. London Elects will use the information provided by you in order to send you updates on the information or events related to the Website. London Elects may also use the information in order to improve and develop the Website and the services provided by London Elects as a whole and may ask you to complete questionnaires regarding your use of the Website and attendance at the events detailed on the Website.
1.2. London Elects will not use your personal information for any purposes not stated when we collect the information, or in this Privacy Policy, without your consent unless required to by law to do so.
1.3. Electronic collection of information: If you are a user with general public and anonymous access, the Website does not store or capture your personal information, but logs the Internet Protocol ("IP") address of your computer. London Elects uses cookies to collect statistics related to your use of the Website and these are used to help London Elects follow browsing preferences and improve future use of the Website. 2. How we protect your information
2.1. The internet is not a secure medium and it is important that you are aware that any information sent via the internet may be intercepted. If you send any information using the feedback forms, questionnaires or via email this will not be sent using a secure transmission method and may be read by others.
2.2. Any personal information collected by London Elects will be held and processed securely using appropriate procedures and all staff and agents processing personal data are aware of their obligations under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. London Elects shall only hold personal information for as long as necessary in order to fulfil the purpose for collecting the information.
2.3. London Elects may transfer the management of the Website to a third party and in such an event you agree to your information being transferred/and or processed by the third party. London Elects will ensure that any organisation managing the Website is contractually obliged to comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and this Privacy Policy.
3. Updating your details
3.1. If any of the information that you have provided to us changes, for example if you change your e–mail address or if you would like us to stop processing your personal information, please let us know by sending an email to [email protected] [or by sending a letter to London Elects, City Hall, Kamal Chunchie Way, London E16 1ZE.
4. Your consent
4.1. By submitting your information you consent to the use of that information as set out in this Privacy Policy. If we change our Privacy Policy we will post the changes on this page, and may place notices on other pages of the Website, so that you may be aware of the information we collect and how we use it at all times. Continued use of the service will signify that you agree to any such changes.
4.2. Owing to the global nature of the Internet infrastructure, the information you provide may be transferred in transit to countries outside the European Economic Area that do not have similar protections in place regarding your data and its use as set out in this policy. However, we have taken the steps outlined above to try to improve the security of your information. By submitting your information you consent to these transfers.
5. Crime prevention and detection
5.1. London Elects may use personal information provided by you to detect and prevent crime and may disclose the information to the police where it believes that such information would assist police investigations.
6. Access to your personal data
6.1. Under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, you have the right to access your personal data. 6.2. You also have the right to request that information is rectified if you believe that it is inaccurate.
